Terms and Conditions - fundamentals
That said, Terms and Conditions (“T&C”) are a set of legally binding terms set by you, as the owner of this website. The T&C establish the legal framework that governs the activities of website visitors, or their customers, during their visit to or interaction with this website. The intention of the T&C is to establish the legal relationship between the website visitors and you, the website owner.
The T&C must be established according to the specific needs and nature of each site. For example, a site that offers products to customers involving e-commerce transactions needs to have T&Cs that are different from the T&Cs of a site that only offers information (such as a blog, a home page forwarding to others, and so on).
T&C give you, as the owner of the website, the possibility to protect yourself against possible legal exposure. However, this may differ from jurisdiction to jurisdiction, so seek local legal advice if you wish to protect yourself from legal exposure.
What to include in the T&C document
In general terms, the T&C usually regulate the following issues: who can use the site; the possible forms of payment; a statement that the website owner may change its offerings in the future; the types of guarantees the website owner gives to their customers; a reference to intellectual property or copyright issues, where relevant; the website owner's right to suspend or terminate a member's account; and much more.
